NOTICE OF THE ANNUAL MUNICIPAL ELECTION OF THE TOWN OF HENLOPEN ACRES
The Town of Henlopen Acres will hold its annual election on Saturday, August 30, 2025, from 9:00 a.m. – 12:00 p.m at Town Hall, 104 Tidewaters, Henlopen Acres, DE.
CANDIDATES ON BALLOT
There are three (3) candidates running for two (2) Commissioner seats in the August 30, 2025, election. Registered voters may vote for up to two (2) candidates. The two (2) candidates receiving the highest number of votes shall be elected for a term of three (3) years. Listed alphabetically, the candidates are:

The Charter of the Town of Henlopen Acres provides that at least four (4) of the seven (7) Commissioners must be bona fide residents of the Town, but all may be residents of the Town. Based on the current composition of the Board of Commissioners, a minimum of one (1) resident Commissioner will be elected in 2025.
VOTER REGISTRATION & ELIGIBILITY
All those eligible who wish to vote in the election must be registered to vote with the Town of Henlopen Acres on or before 4:30 p.m. on July 31, 2025. Voter registration forms are available at Town Hall or at henlopenacres.delaware.gov/elections.
To vote as a resident, you must be 18 years or older on the date of the annual election, be a citizen of the United States, and reside primarily in the Town of Henlopen Acres for at least 30 days prior to the date of the annual election. To vote as a nonresident property owner, you must must be 18 years or older on the date of the annual election, be a citizen of the United States, and be a real property owner for at least 30 days prior to the date of the annual election. A real property owner includes any person or artificial entity that holds at least 50% fee simple interest in real property in the Town. Artificial entities (i.e. LLCs and trusts) shall have one (1) vote to be cast by a person named in a certificate, filed for each election, providing legal authorization for the person to vote on behalf of the artificial entity. Certificates of Authorization for artificial entities are available from Town Hall and must be completed and returned to Town Hall on or before 4:30 p.m. on July 31, 2025.
ABSENTEE BALLOTS
Registered voters may request an absentee ballot from the Town Clerk in person at Town Hall, by phone at 302-227-6411, or via email at townclerk@henlopenacres.com. Absentee ballot packets can be sent to registered voters by mail or picked up in person from Town Hall. The deadline to request an absentee ballot packet be sent by mail is on or before 4:30 p.m. on Tuesday, August 26, 2025. The deadline to request an absentee ballot packet for in person pick up is on or before 12:00 p.m. on Friday, August 29, 2025. Completed absentee ballots can be returned by mail or in person and must be received at Town Hall before the polls close at 12:00 noon on Saturday, August 30, 2025.
VOTING RESULTS
Results of the election will be posted at Town Hall by 1:00 p.m. the day of the election.

MORATORIUM ON TREE REMOVAL EXTENDED TO JANUARY 2026
NOTICE TO HENLOPEN ACRES PROPERTY OWNERS
AND BUSINESS LICENSE HOLDERS
At their July 11, 2025 meeting, the Town of Henlopen Acres Board of Commissioners voted to once again extend the moratorium on severely cutting back, topping, damaging, or removing canopy trees, as defined below, on private property located in the first 10-feet of the front setback closest to the Town right-of-way, or in any part of the side and rear setbacks.
CANOPY TREE – A tree that normally grows to a mature height of 40 or more feet whose branches and foliage create substantial shade underneath. Includes large deciduous trees such as oaks, maples, beech, hickory, sycamore, and tulip poplar trees, but also includes certain tall evergreens such as loblolly pines as outlined on the Town of Henlopen Acres Approved Tree List.
The Town Manager, for good cause shown, maintains the authority to allow a canopy tree in the protected setback areas to be severely cut back, topped, or removed.
The moratorium was initially set to expire on July 10, 2025. An initial extension to September 30, 2025 was approved by the Board of Commissioners at their June 13, 2025 meeting. With the second approved extension, it will now continue until and including January 31, 2026 unless sooner lifted by the Board of Commissioners.
The decision to extend the moratorium was made to provide the Board of Commissioners with additional time to carefully consider and revise possible amendments to Chapter 114, Trees, of the municipal code based on the valuable feedback received from the community.
The extension will also ensure that Town staff have adequate time to plan for and implement any new policies or regulations that may result from this process.
There will be discussion and possible action on amendments to Chapter 114, Trees, at future meetings of the Board of Commissioners to be scheduled.
