NOTICE OF SOLICITATION OF CANDIDATES
The annual election for the Town of Henlopen Acres Board of Commissioners will be held on Saturday, August 29, 2026, from 9:00 a.m. – 12:00 p.m. at Town Hall, 104 Tidewaters, Henlopen Acres, DE. Three (3) Commissioners shall be elected for three (3) year terms.
Anyone wishing to file as a candidate for Commissioner must file their Notice of Intention to Seek Office with the Town Manager or Mayor of the Town of Henlopen Acres on or before 4:30 p.m. on Friday, July 10, 2026. Contact Town Hall at 302-227-6411 or townhall@henlopenacres.com to obtain the appropriate forms.
The Charter of the Town of Henlopen Acres provides that at least four (4) of the seven (7) Commissioners must be bona fide residents of the Town, but all may be residents of the Town. A minimum of two (2) resident Commissioners will be elected in 2026. Accordingly, prospective candidates will be requested to file their intent to run as a resident or nonresident Commissioner.
Candidates for Commissioner must meet all the following requirements:
- Be at least twenty-one (21) years of age;
- Be a U.S. citizen;
- Be a registered voter in the Town;
- Shall not have been convicted of a felony;
- Shall have been a bona fide resident of the Town for a period of at least one (1) year prior to the date of the election OR shall have been a nonresident real property owner for a period of at least one (1) year prior to the date of the election. A real property owner includes any person with at least 50% fee simple interest in real property in Henlopen Acres OR at least 50% interest in an artificial entity having 100% ownership interest in real property in Henlopen Acres.
VOTER REGISTRATION
To be eligible to vote, you must register with the Town of Henlopen Acres on or before 4:30 p.m. on July 30, 2026. Registration forms are available at Town Hall or at the link below and may be returned in person or by mail to Town Hall, 104 Tidewaters, Henlopen Acres, DE 19971.
If registering as a bona fide resident, a copy of your driver’s license or other photo ID with a Town address must be provided.
If you are a nonresident property owner whose property is titled in a trust, LLC, or other type of artificial entity, an additional form is required to designate a single voter for the entity. Please contact townhall@henlopenacres.com to complete this additional step.
ABSENTEE VOTING
Registered voters who meet one of the eligibility criteria established in § 16-9 of the Town Code may request an absentee ballot packet from Town Hall beginning July 15, 2026. The deadline to request an absentee ballot packet be sent by mail is on or before 4:30 p.m. on Tuesday, August 25, 2026. The deadline to request an absentee ballot packet in person at Town Hall is on or before 12:00 p.m. on Friday, August 28, 2026. Completed absentee ballots must be received at Town Hall no later than 12:00 noon on Saturday, August 29, 2026.
