Notice of Solicitation of Candidates
The annual election for the Town of Henlopen Acres Board of Commissioners will be held on Saturday, August 30, 2025, from 9:00 a.m. – 12:00 p.m at Town Hall, 104 Tidewaters, Henlopen Acres, DE. Two (2) Commissioners shall be elected for three (3) year terms.
Anyone wishing to file as a candidate for Commissioner must file their Notice of Intention to Seek Office with the Town Manager or Mayor of the Town of Henlopen Acres on or before 4:30 p.m. on Friday, July 11, 2025. Contact Town Hall at 302-227-6411 or townhall@henlopenacres.com to obtain the appropriate forms.
The Charter of the Town of Henlopen Acres provides that at least four (4) of the seven (7) Commissioners must be bona fide residents of the Town, but all may be residents of the Town. A minimum of one (1) resident Commissioner will be elected in 2025. Accordingly, prospective candidates will be requested to file their intent to run as a resident or nonresident Commissioner.
Candidates for Commissioner must meet all of the following requirements:
- Be at least twenty-one (21) years of age;
- Be a U.S. citizen;
- Be a registered voter in the Town;
- Shall not have been convicted of a felony;
- Shall have been a bona fide resident of the Town for a period of at least one (1) year prior to the date of the election OR shall have been a nonresident with at least a 50% interest in an artificial entity having a 100% ownership interest in a Henlopen Acres property for a period of at least one (1) year prior to the date of the election.
Voting and Absentee Ballots
To be eligible to vote, you must register with the Town of Henlopen Acres on or before 4:30 p.m. on July 31, 2025. Registration forms are available at Town Hall or at henlopenacres.delaware.gov/elections and may be returned in person or electronically to Town Hall at townhall@henlopenacres.com. If registering as a bona fide resident, a copy of your driver’s license or other photo ID with a Town address must be presented. If you are a nonresident property owner whose property is titled in a trust or LLC, an additional form is required to designate a single voter for the entity. This form is available at Town Hall or at henlopenacres.delaware.gov/elections.
Registered voters may request an absentee ballot packet from Town Hall beginning July 15, 2025. The deadline to request an absentee ballot packet be sent by mail is on or before 4:30 p.m. on Tuesday, August 26, 2025. The deadline to request an absentee ballot packet in person at Town Hall is on or before 12:00 p.m. on Friday, August 29, 2025. Completed absentee ballots must be received at Town Hall no later than 12:00 noon on Saturday, August 30, 2025.

Notice is hereby given, that the Mayor and Commissioners of the Town of Henlopen Acres will hold a PUBLIC HEARING at 10:00 a.m. on Friday, May 23, 2025, at Henlopen Acres Beach Club, 28 Dune Way, Rehoboth Beach, Delaware, Sussex County. The hearing may also be viewed through live video broadcast.
The purpose of the Public Hearing is to hear comments on an Ordinance to amend Chapter 114, Trees, of the municipal code of the Town of Henlopen Acres, by replacing Chapter 114, Trees, in its entirety with a new Chapter 114, Trees. This amendment would establish restrictions on the removal of canopy trees located in the setbacks of residential lots within the Town of Henlopen Acres, establish new requirements for minimum tree density during new home construction or the renovation of existing homes, and establish requirements for maintaining trees on residential lots.
The proposed Ordinance would require owners to obtain a Town permit to remove a tree in the side and rear setbacks and in the first 10 feet of the front setback, with approval for removal based on the satisfaction of specified criteria for removal and a penalty for noncompliance of $2,500 per tree. The Ordinance would also increase the required minimum density of trees on a residential lot following construction of a new dwelling or renovation of an existing dwelling from one tree per 2,000 square feet of required open space to one tree per 2,000 square feet of lot size, and with at least sixty percent canopy shade trees and forty percent evergreens. Finally, the Ordinance would require that residents maintain trees on their lot to promote healthy tree growth. This includes trimming and treating trees as needed and removing climbing vines so that trees flourish.
The Board of Commissioners welcomes all residents and property owners to attend the hearing and make comment. Comments may also be submitted in writing by U.S. mail to 104 Tidewaters, Henlopen Acres, DE 19971 or email at townhall@henlopenacres.com. The public comment period will close at 4:30pm on Friday, May 30, 2025.
